India24bet New ID: Tax on Betting Winnings in India After the 2023 Changes

An India24bet-style new ID from GameWinExch gives you a rupee account opened over WhatsApp and funded by UPI. What it does not give you is a tax certificate, and since 2023 that gap matters more than it used to. Two changes that year rewrote how the Indian tax system treats money won online: a 28 percent GST on deposits for online money gaming and a dedicated 30 percent TDS regime for net winnings. This page explains both in plain terms, works through the sums, and sets out what an individual bettor on an offshore panel is actually expected to do.

The Two Changes of 2023

The first change came through the Finance Act 2023 and took effect on 1 April 2023. It added section 115BBJ, which taxes net winnings from online games at a flat 30 percent with no basic exemption and no deductions, and section 194BA, which requires the platform to deduct that 30 percent as TDS. The second change came through the GST Council in July and August 2023 and took effect on 1 October 2023. It imposed 28 percent GST on the full face value of deposits made with online money gaming platforms, whether the game is skill-based or chance-based. Before October 2023, platforms had argued that only their platform fee was taxable; after it, every rupee deposited attracts the levy.

How the 30 Percent TDS Is Calculated

Section 194BA works on net winnings, not on individual bets. Net winnings for a financial year equal total withdrawals minus total deposits minus the opening balance on 1 April, with any closing balance at 31 March treated as a withdrawal. A licensed Indian platform must deduct 30 percent at the time of each withdrawal on the net winnings to that point, and again at year end on whatever remains in the account. A worked example makes it clearer.

  • Deposits during the year: 60,000 rupees.
  • Withdrawals during the year: 95,000 rupees.
  • Opening balance: zero. Closing balance: 5,000 rupees.
  • Net winnings: 95,000 plus 5,000 minus 60,000, which is 40,000 rupees.
  • Tax due: 30 percent of 40,000, which is 12,000 rupees, plus the applicable cess.

There is no threshold. Earlier rules exempted single wins below 10,000 rupees; the 2023 regime removed that for online games. Losses cannot be set off against other income, and losses from one platform cannot be set off against winnings on another.

The 28 Percent GST on Deposits

GST is charged on the platform, not on the player, but the platform collects it from the player in practice. Deposit 1,000 rupees with a compliant Indian platform after October 2023 and the platform must account for 28 percent GST on that 1,000, so either your playable balance falls to roughly 781 rupees or the platform absorbs the levy and prices it into its margins. Winnings that are redeposited as fresh stakes are not taxed again, which is the one concession the Council made. The levy was designed with fantasy apps and rummy platforms in mind, and it hit them hard: several fantasy platforms cut bonuses or shut down within months.

Why Offshore Panels Deduct Nothing

An offshore panel has no Indian GST registration and no TAN, so it neither charges GST on your deposit nor deducts TDS on your withdrawal. That feels like a 28 percent head start, and it is why panel odds look generous next to a compliant fantasy app. But the tax liability does not disappear. Section 115BBJ taxes the individual on net winnings from any online game; the deduction at source is just the collection mechanism. When no one deducts, the obligation to declare and pay moves entirely to you, and the 28 percent GST that a platform would have paid is, in the eyes of the law, still owed by the platform, not by you. So the practical position of a bettor on an offshore panel is: no GST cost, a 30 percent income tax liability on net winnings that nobody collects for you, and the full record-keeping burden.

What Records to Keep

Because net winnings are calculated over a financial year, you need the year’s deposits and withdrawals in one place. A simple sheet with the date, the UPI reference, the amount and the direction is enough. Screenshot the panel balance on 1 April and 31 March. Keep the bank statement lines that show the transfers. If you are ever asked to explain a pattern of UPI credits, that sheet is the difference between a five-minute answer and a very long one. Net winnings are reported under income from other sources at the special rate, and a chartered accountant who handles online-gaming income will know the schedule. The online betting ID page has a short section on keeping deposit and withdrawal logs, and the ID life-cycle guide covers closing an account with a clean final withdrawal, which makes the year-end figure easy to read.

What This Means for Stake Sizing

A bettor who nets 40,000 rupees in a year and pays 12,000 in tax has really netted 28,000. Any calculation of whether a betting habit pays should be done after that 30 percent, and after the time spent. For most people that changes the answer from a small profit to a small loss, which is a useful thing to know before the next season rather than after it. Treat the tax as a real cost, keep the records, and decide with the true number in front of you. The South African system makes an instructive comparison: there the operator collects the tax at source and the bettor never has to think about it, which is the one real advantage of a regulated market.

Frequently Asked Questions

Do I have to pay tax on winnings from an offshore panel?

Yes. Section 115BBJ taxes net winnings from online games regardless of where the platform is based. The absence of TDS changes who collects, not whether the tax is owed.

Is there any exemption for small winnings?

Not for online games after April 2023. The old 10,000 rupee threshold still applies to some offline lottery and card game winnings under section 194B, but not to online gaming income.

Can I deduct my losses?

Losses are netted within the year on the same platform because the tax is on net winnings, but a net loss cannot be carried forward or set off against salary or any other income.

Does GST come out of my deposit on an offshore panel?

No, because the panel is not registered for Indian GST. That is a cost saving in practice, but it also means the panel is operating outside the Indian tax system entirely, with everything that implies about recourse.

Where do I report the income?

Under income from other sources at the special rate for online gaming winnings, in the return form that allows special-rate income. If the amounts are meaningful, use a professional who has filed this schedule before.

Betting is for people over 18, and a habit that only looks profitable before tax is a habit funded by money you should not have risked.
